Legal Situation: Lifting of the Ban on Social Egg Freezing
Until now, egg freezing in Austria was only permitted for medical reasons (e.g., before chemotherapy). However, an important legal change is on the way:

The Constitutional Court (VfGH) has declared the complete ban on Social Egg Freezing unconstitutional.

Freezing eggs for social or personal reasons will be legally permitted in the future.

This new regulation will take effect on April 1, 2027. Until then, the current legal framework remains in force.

The legislator has until that date to define new legal conditions – such as counseling requirements, possible age limits, clear rules on advertising, and financial incentives.

The court’s decision is based on the right to private and family life (Art. 8 ECHR): A general ban was deemed disproportionate and a restriction of personal freedom.
Egg Freezing in Austria and Your Options
While egg freezing is already part of family planning in many countries, our fertility clinic in Graz may continue to freeze eggs only for medical reasons until March 31, 2027. The following indications are legally permitted:

Preservation of fertility prior to planned medical treatments (e.g., chemotherapy or radiation therapy)

Primary Premature Ovarian Insufficiency (POI)

Severe endometriosis with proven reduction in ovarian reserve

Planned removal of the ovaries

Severe autoimmune diseases and/or their treatment
Starting in April 2027, women will be able to freeze their eggs even without a medical indication – regardless of individual life plans. Details on counseling, age limits, and costs will be defined by law by that time.

Egg freezing is currently the only method to counteract the natural time limitation of female fertility. Success rates for the later use of cryopreserved eggs range between 60 and 85 percent – the age at the time of retrieval and use plays a decisive role. The most promising results are achieved when eggs are collected before the age of 35.

Procedure & Initial Consultation
Your first appointment is intended to get to know our team and to discuss the entire process in detail. The consultation includes a personal discussion, a vaginal ultrasound examination, and, if necessary, a semen analysis. Ideally, both partners attend. Relevant previous findings and a brief written summary are helpful. Please note: Appointments must be canceled at least 24 hours in advance; otherwise, a fee of EUR 100 will be charged.
